The NFL PLAY 60 Super Bowl Contest presented by Danimals (hereafter the “Contest”) is open to legal permanent residents of the fifty (50) United States and District of Columbia, eighteen (18) years of age or older that is a parent/legal guardian of a child(ren) six (6) through twelve (12) years of age as of the date of entry (hereafter, “Eligible Child”). Employees, officers, directors, agents and representatives (and the respective children or legal wards of each) of the NFL Properties LLC (hereafter, “Sponsor”), National Football League, the NFL Entities (defined as National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees), The Dannon Company, teamDigital Promotions, Inc. and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (hereafter collectively, “Released Parties”), and any such individual’s immediate family members (mother, father, sister, brother, daughter, son and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws apply.
2. Contest Submission Period:
Contest submission period begins at 12:00:00 p.m. (noon) Eastern Time (“ET”) on 9/12/19 and ends at 12:00:00 p.m. (noon) ET on 10/23/19 (hereafter, “Contest Submission Period”).
3. How To Enter the Contest:
To participate, visit NFLRUSH.com/superkid (hereafter, “Site”) using your personal computer or mobile device during the Contest Submission Period and complete and submit the registration form inclusive of a sixty (60) second video of only your Eligible Child showing and telling why he/she should be the next NFL PLAY 60 Super Kid (hereafter, the “Theme”). Video and registration form shall be collectively referred to hereafter as the “Entry". Limit one (1) Entry per parent email address and Eligible Child name for the duration of the Contest Submission Period. In case of multiple Entries from any one parent email address and Eligible Child name, only the first Entry received will be accepted. All Entries must meet the Contest Entry Requirements set forth below.
Contest Entry Requirements:
Video must (i) be original; (ii) be complete; (iii) be filmed and/or created by you; (iv) be in English; and (v) only include the Eligible Child (no other individuals and no personally identifiable information of Eligible Child may be included in the video). Video must be no more than sixty (60) seconds in length, in AVI, MOV MP4, MPEG, WMV or FLV video file format not exceeding 500 MB in size. To be eligible, any Entry (and individual components therein) cannot have been previously published or submitted in any competition or have won any awards. In addition, to be eligible, Entry must not include any third party packaging, logos or any other third party intellectual property or general property other than NFL Team names, logos or slogans (hereafter, “Permitted Marks”), unless requisite permission is obtained. Entry cannot violate any federal, state or local laws or ordinances, defame or invade publicity and/or intellectual property rights or the privacy of any person, living or deceased, or otherwise infringe upon any copyrighted, trademarked, or patented works or person’s personal or proprietary rights, other than as outlined above. Entry may also not contain, as determined by Sponsor in its sole discretion, any content that is sexually explicit or suggestive, violent or derogatory, profane or pornographic, contains nudity; promotes alcohol, contains alcoholic beverages in the Entry, illegal drugs, tobacco, firearms/weapons (or use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, other than as outlined above; contains any personal identification (other than as provided in the registration form); contains materials embodying the names, likenesses, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without requisite permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or violates any law. Entries deemed by the judges, in their sole discretion, to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. In the event of non-compliance with any requirements specified herein or with any of the terms of these Official Rules, Entry will be void.
Message and data rates may apply if you choose to enter using your mobile device. Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Sponsor’s sole discretion. Entries must be received during the Contest Submission Period to be eligible. The use of script, macro or any other device to automate or subvert the entry process is prohibited and all such Entries and Entries made by any other means which subvert the entry process will be void. In the case of a dispute as to the entrant who submitted an Entry, Entry will be deemed made by the person named on the applicable registration form (regardless of whether that is the name of the authorized account holder of the email address from which said Entry was submitted) and he/she must comply with these Official Rules. Neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any entrant regarding anything outside of this Contest. Entry not meeting all Contest Entry Requirements stated herein will be void.
If the Entry contains any material or elements that are not owned by the entrant (with the exception of Permitted Marks), and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she is a parent or legal guardian of the Eligible Child identifiable in the Entry, has obtained permission from any other parents or legal guardians of such Eligible Child (as applicable) and consents to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein.
Sponsor grants to entrant a limited revocable, non-sub-licensable, license to use the Permitted Marks for the sole purpose of creating an Entry and entrant may make no further use whatsoever of the Entry for any purpose whatsoever. In addition, entrant recognizes that all of the right, title, and interest in the Permitted Marks as well as all derivative works created using the Permitted Marks (including the Entry) shall vest exclusively in Sponsor, and entrant will not have or take any action that might harm or adversely affect such rights. No right, title, or interest in and to the Permitted Marks except for the limited license granted to entrant in these Official Rules is transferred or created.
By submitting an Entry, entrant hereby grants the Released Parties, without any limitation of any other rights granted herein, permission for the Entry to be posted on the Site and other websites as determined by Sponsor in its sole discretion. Entrant agrees that Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may remove a posted Entry at any time.
By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many submissions under this Contest and that such Entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other promotions staged and/or sponsored by the Sponsor, or to other ideas conceived by or provided to Sponsor and entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Entry. Except where prohibited by law, each entrant acknowledges and agrees that the Sponsor does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant’s Entry or any other right related thereto.
5. Determination of Contest Winners:
A) Contest Entry Judging Phase:
Round 1 of Judging Phase: All eligible Entries received will be judged on the following criteria by teamDigital Promotions, Inc., an independent judging organization: 1) Articulate: does the Entry convey why the child would be the best PLAY 60 Super Kid: 0-25 points; 2) Passionate: does the Entry reveal the child’s passion for what PLAY 60 stands for: 0-25 points; 3) Presentation: does the child in the Entry deliver his/her message with compelling expression and appeal: 0-25 points; and 4) Level of originality in the child’s message: 0-25 points (collectively, the “Judging Criteria”). The twenty (20) Entries with the highest scores, as determined in Round 1 by the judges in their sole discretion, will advance to Round 2 judging. Sponsor and teamDigital Promotions, Inc. reserve the right to advance fewer than twenty (20) Entries to Round 2 if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries.
Round 2 of Judging Phase: During Round 2 of judging, a separate panel of qualified judges, determined by Sponsor (in its sole discretion), will judge each of the top twenty (20) Entries based on the Judging Criteria specified above. The eight (8) Entries receiving the highest scores during Round 2 of the judging, as determined by the judges in their sole discretion, will be deemed potential Finalists, and upon verification of eligibility and compliance with these Official Rules, will receive a Finalist Prize and advance to the Interview Phase outlined below. Sponsor and judges reserve the right to advance fewer than eight (8) Finalist Entries if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries.
In the event of a tie, the tied Entries will be re-judged based on: Presentation: does the child in the entry deliver his/her message with compelling expression and appeal: 0-100 points. By participating, entrants agree to abide by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters relating to this Contest.
Upon verification of eligibility and compliance with these Official Rules, each Finalist will advance to the Interview Phase.
B) Finalist Notification:
Potential Finalists will be selected on or about 11/9/19 and will be notified by telephone and/or email. Potential Finalists will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release with any other documents required by Sponsor within two (2) days of date of issuance of notification.
Further proof or verification of identity and qualifications may be required along with a background check and entrant, by participating, agrees to such check and agrees to provide full consent if required. Failure to comply may result in disqualification and, based on the criteria described above and time permitting, selection of another Finalist to compete in the Interview Phase. In addition, at the discretion of the Sponsor, potential Finalist(s) Entry may be disqualified for any of the following: if entrant is charged with or convicted of a felony or misdemeanor, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government ordered payment, such as but not limited to: child support, spousal support, alimony, tax payments, etc. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a potential Finalist within a reasonable time period or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, a runner-up being chosen. Finalist status is subject to verification of eligibility and compliance with these Official Rules.
C) Interview Phase
Upon verification of the Finalists, the Entry that each Finalist submitted will hereafter be referred to as a “Finalist Entry”. Sponsor will schedule a video chat with the entrant of each Finalist Entry and his/her Eligible Child depicted in the Finalist Entry (each, an “Eligible Subject”) and such Finalist entrant must be present at the time of the video chat interview. The interviewer(s) (hereafter, “Interviewer(s)”) hosting the interview of the Finalist Eligible Subjects are determined by Sponsor in its sole discretion. The interview with each Finalist Eligible Subject will be approximately the same length of time, and the questions asked of each will be the same. All interviews will be recorded and must be completed by 11/25/19. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a Finalist within a reasonable time period and/or schedule and complete the interview, or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, a runner-up being chosen.
D) Winner Determination:
Upon completion of all Interviews, the Finalist Entries will be ranked from one through three (with one being the highest ranked) based on the following: (i) Sponsor’s ranking of the Finalist Entries based on presentation (does the Eligible Child in the Entry deliver his/her message with compelling expression and appeal); and (ii) Interviewer(s) ranking of the videos based on presentation (does the Eligible Child in the Entry deliver his/her message with compelling expression and appeal). Both of the rankings will carry equal weight. The highest ranked Finalist Entry will be determined the Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie during the Contest Voting Period, such tied Finalist Entries will be re-judged (by a panel of judges determined by Sponsor in its sole discretion) based on Presentation: does the Eligible Child in the Entry deliver his/her message with compelling expression and appeal: 0-100 points.
Eight (8) Finalist Prizes: Each Finalist will receive a PLAY 60 prize pack. Exact items, colors and sizes are at Sponsor’s sole discretion. Approximate Retail Value (“ARV”) of each Finalist prize pack = $126.
One (1) Grand Prize: The Grand Prize winner will receive i) a seven (7) day/six (6) night trip for four (4) (winning entrant, his/her Eligible Child and up to two (2) additional Guests) to attend Super Bowl LIV scheduled to take place on 2/2/20 in Miami Gardens, FL. Grand Prize trip consists of a) round trip coach class air transportation for four (4) from a major U.S. gateway airport nearest winner’s residence to destination city; b) standard hotel accommodations (one (1) room, quadruple occupancy) for six (6) nights; c) attendance for four (4) at NFL Kids’ Day at Super Bowl LIV; d) four (4) tickets to Super Bowl LIV; e) NFL car service to and from the game; and f) a total of $1,000 spending money awarded (to winning entrant only) in the form of a check. Additionally, the Eligible Subject will have the opportunity to be on the field for the Super Bowl LIV pre-game. ARV of Grand Prize package = $23,990. Actual prize value may vary based upon location of winner’s residence. Any difference between stated value and actual value will not be awarded. If winner resides within a one hundred fifty (150) mile radius of Miami, FL, ground transportation may be provided in lieu of air transportation at Sponsor’s sole discretion, and no compensation or substitution will be provided for difference in prize value. Trip must be taken on dates designated by Sponsor or prize will be forfeited in its entirety and, at Sponsor's discretion, awarded to a runner-up. Travel and accommodation restrictions and other restrictions may apply. Winner and his/her guest(s) must travel together on same itinerary for both trips and are responsible for obtaining all required travel documents. All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Released Parties are not responsible for travel delays or cancellations. In the event Super Bowl LIV is postponed and rescheduled, the trip will be rescheduled. In the event any related event is postponed and not rescheduled, no compensation or substitution for such portion of the prize will be provided; however, the remainder of prize package will be awarded and Sponsor will have no further obligation to winner.
For Finalist and Grand Prizes: Seat locations will be determined by the Sponsor in its sole discretion. Winner and guest(s) must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Released Parties reserve the right to remove or to deny attendance to any winner and/or guest(s) who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at a game or any event. The tickets are subject to the terms and conditions specified thereon. If unused, tickets cannot be returned, refunded or exchanged for cash value or substitute tickets.
For all Prizes: All prize details will be determined by Sponsor in its discretion. All prizes are awarded “as is” without any warranty or guarantee, either expressed or implied, by Sponsor. Costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, (and as applicable, food, beverages, luggage fees, souvenirs, gratuities and miscellaneous travel expenses) are winners' sole responsibility. A 1099 tax form will be issued in the amount of the prize to the winning entrant. Total ARV of all prizes = $25,046.
7. Miscellaneous; Release and Limitations of Liability:
Contest Entry Assignment of Rights: Entrants warrant and represent that (1) Sponsor shall own the Entry (and all material and rights embodied therein) and that such Entry will not be acknowledged or returned; and (2) that by entering, the Entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (3) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, publish, exploit and use the Entry in any way and in any and all media now known or hereinafter discovered or devised, world-wide for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to entrants or any third parties.
Entrants further agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding. Entrant's submission of an Entry constitutes his/her representation of eligibility, consent to participate in Contest and consent for Sponsor to obtain, use, and transfer his/her name, address and other information for the purpose of Contest administration. Released Parties are not responsible for lost, incomplete, invalid, unintelligible, inaccurate, undeliverable, garbled, late, stolen, damaged or misdirected Entries, all of which will be disqualified; failures or malfunctions of phones, phone lines or telephone systems or other communications or malfunctions; interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrants’ or any other person’s computer or mobile device related to or resulting from participation in the Contest; theft, destruction or unauthorized access to, or alteration of, Entries; or human-processing error; printing, typographical or other errors or omissions in these Official Rules or in any Contest-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, network, electronic; or errors which may occur in connection with the administration of the Contest, the incorrect uploading of Entries, the processing or judging of Entries, the awarding or announcement of the winners, Finalists or in any other Contest-related materials. Sponsor reserves the right to void and remove any and all Entries of an entrant who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Contest and such entrant will be disqualified and all associated Entries will be void. All Entries become property of Sponsor and will not be returned. Sponsor reserves the right, in its sole discretion, to post all approved Entries on NFLRUSH.com/superkid for public viewing. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON(S) FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Except where prohibited by law, as a condition of participating in this Contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.
9. Choice of Law:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
