1) Eligibility: The 2017 NFL PLAY 60 Super Bowl Contest (hereafter the “Contest”) is open to legal permanent residents of the fifty (50) United States and District of Columbia, eighteen (18) years of age or older that is a parent/legal guardian of a child(ren) six (6) through twelve (12) years of age as of the date of first entry (hereafter, “Eligible Child”). Employees, officers, directors, agents and representatives (and the respective children or legal wards of each) of the NFL Properties LLC (hereafter, “Sponsor”), National Football League, the NFL Entities (defined as the National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees), The Dannon Company, Inc. (“Dannon”), teamDigital Promotions, Inc. and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (hereafter collectively, “Released Parties”), and any such individual’s immediate family members (mother, father, sister, brother, daughter, son and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws apply.
2) Contest Submission Period: Contest submission period begins at 12:00:00 p.m. (noon) Eastern Time (“ET”) on 9/21/17 and ends at 12:00:00 p.m. (noon) ET on 10/19/17 (hereafter, “Contest Submission Period”).
3) Voting Period: The voting period begins at 12:00:00 p.m. (noon) Eastern Time (“ET”) on 11/22/17 and ends at 12:00:00 p.m. (noon) ET on 12/5/17 (hereafter, “Voting Period”).
4) How To Enter the Contest: To enter the Contest in one (1) of the four (4) ways outlined below during the Contest Submission Period, submit a video (up to a maximum of twenty (20) seconds in length) that shows off your Eligible Child’s Super Kid Celebration Dance (“Theme”) (hereafter, “Video”).
Four (4) Ways to Submit a Video:
1) Online: During the Contest Submission Period, visit NFLRUSH.com/superkid and follow the instructions to complete and submit the registration form inclusive of uploading your Video.
2) Twitter: During the Contest Submission Period, tweet your Video on Twitter through your Twitter account inclusive of the hashtag #PLAY60Contest (the “Twitter Hashtag”). Twitter Hashtag must be used in order for your entry to be eligible. Your Twitter account must be public to enter using this method. If you do not have a Twitter account, you can create a free Twitter account at www.twitter.com. Any Video on Twitter tagged with the Twitter Hashtag on Twitter may be eligible for submission into this Contest. Use of the Twitter Hashtag in connection with your Twitter post constitutes your unconditional acceptance of these Official Rules. All submissions must comply with the Twitter Terms of Service and Twitter Rules available at www.twitter.com.
3) Instagram: During the Contest Submission Period, post your Video on Instagram through your Instagram account inclusive of the hashtag #PLAY60Contest (the “Instagram Hashtag”). Instagram Hashtag must be used in order for your entry to be eligible. Your Instagram account must be public in order to be eligible. If you do not have an Instagram account, you can create a free Instagram account at www.instagram.com. Any Video tagged with the Instagram Hashtag on Instagram may be eligible for submission into this Contest. Use of the Instagram Hashtag in connection with your Instagram post constitutes your unconditional acceptance of these Official Rules, and you acknowledge and agree that the Sponsor has the right to stream your post through the Instagram API or otherwise use your post as set forth in its online Terms and Conditions at http://instagram.com/about/legal/privacy.
4) Facebook: Visit https://www.facebook.com/CommunityNFL/ and look for a NFL PLAY 60 brand post which will appear on the Facebook wall. Post your Video as a comment to the Contest post inclusive of hashtag #PLAY60Contest and (the “Facebook Hashtag”) to receive one (1) entry.
The registration form (if applicable), Twitter Hashtag, Instagram Hashtag, Facebook post, Facebook Hashtag and Video shall be collectively referred to hereafter as the “Submission”. Submissions must be submitted and received during the Contest Submission Period to be eligible.
Contest Submission Requirements:
Video must (i) be original; (ii) be complete; (iii) be filmed and/or created by you; (iv) be in English; and (v) only include the Eligible Child (no other individuals and no personally identifiable information of Eligible Child may be included in the video). Video must be no more than twenty (20) seconds in length, in AVI, MOV MP4, MPEG, WMV or FLV video file format not exceeding 100 MB in size (or within a file size acceptable to the social media channel used to enter). To be eligible, any Submission (and individual components therein) cannot have been previously published or submitted in any competition or have won any awards. In addition, to be eligible, Submission must not include any third party packaging, logos or any other third party intellectual property or general property other than NFL Team names, logos or slogans (hereafter, “Permitted Marks”), unless requisite permission is obtained. Entrant shall not be permitted, by these Official Rules or otherwise, to use any names of NFL players, NFL stadiums or employees or officers of the NFL or any NFL team. Submission cannot violate any federal, state or local laws or ordinances, defame or invade publicity and/or intellectual property rights or the privacy of any person, living or deceased, or otherwise infringe upon any copyrighted, trademarked, or patented works or person’s personal or proprietary rights, other than as outlined above. Submission may also not contain, as determined by Sponsor in its sole discretion, any content that is sexually explicit or suggestive, violent or derogatory, profane or pornographic, contains nudity; promotes alcohol, contains alcoholic beverages in the Submission, illegal drugs, tobacco, firearms/weapons (or use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, other than as outlined above; contains any personal identification (other than as provided in the registration form); contains materials embodying the names, likenesses, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without requisite permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or violates any law. Entries deemed by the judges, in their sole discretion, to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. In the event of non-compliance with any requirements specified herein or with any of the terms of these Official Rules, Submission will be void.
Message and data rates may apply if you choose to enter or vote using your mobile device. Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Sponsor’s sole discretion. Entries must be received during the Contest Submission Period to be eligible. The use of script, macro or any other device to automate or subvert the entry process is prohibited and all such Entries and Entries made by any other means which subvert the entry process will be void. In the case of a dispute as to the entrant who posted a Submission, Submission will be deemed made by the person named on the applicable registration form (regardless of whether that is the name of the authorized account holder of the email address from which said Submission was submitted) and he/she must comply with these Official Rules. Neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any entrant regarding anything outside of this Contest. Submission not meeting all Submission requirements stated herein will be void.
If the Submission contains any material or elements that are not owned by the entrant (with the exception of Permitted Marks), and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to posting of the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Submission null and void. By posting a Submission, entrant warrants and represents that he/she is a parent or legal guardian of the Eligible Child identifiable in the Submission, has obtained permission from any other parents or legal guardians of such Eligible Child (as applicable) and consents to the submission and use of the Submission in the Contest and to its use as otherwise set forth herein.
Sponsor grants to entrant a limited revocable, non-sub-licensable, license to use the Permitted Marks for the sole purpose of creating a Submission and entrant may make no further use whatsoever of the Submission for any purpose whatsoever. In addition, entrant recognizes that all of the right, title, and interest in the Permitted Marks as well as all derivative works created using the Permitted Marks (including the Submission) shall vest exclusively in Sponsor, and entrant will not have or take any action that might harm or adversely affect such rights. No right, title, or interest in and to the Permitted Marks except for the limited license granted to entrant in these Official Rules is transferred or created.
By posting a Submission, entrant hereby grants the Released Parties, without any limitation of any other rights granted herein, permission for the Submission to be posted on the Site and other websites as determined by Sponsor in its sole discretion. Entrant agrees that Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Submission and may remove a posted Submission at any time.
By posting a Submission, entrant acknowledges and agrees that Sponsor may obtain many submissions under this Contest and that such Entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other Promotions staged and/or sponsored by the Sponsor, or to other ideas conceived by or provided to Sponsor and entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Submission and/or other works accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Submission. Except where prohibited by law, each entrant acknowledges and agrees that the Sponsor does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant’s Submission or any other right related thereto.
5) Determination of Contest Winners:
A. Round 1 of Judging: All eligible Entries received will be judged on the following criteria by teamDigital Promotions, Inc., an independent judging organization: 1) Relevance to the Theme: 0-25 points; 2) Entertainment Value: 0-25 points; 3) Ability to Portray Passion: 0-25 points; and 4) Creativity: 0-25 points (collectively, the “Judging Criteria”). The thirty (30) Entries with the highest scores, as determined in Round 1 by the judges in their sole discretion, will advance to Runner-up Notification. Sponsor and teamDigital Promotions, Inc. reserve the right to advance fewer than thirty (30) Entries to Runner-up Notification if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries.
Potential Runner-up entrants will be selected on or about 10/30/17 and will be notified by telephone, email and/or overnight mail. Potential Runner-up entrants may be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release with any other documents required by Sponsor within two (2) days of date of issuance of notification.
Further proof or verification of identity and qualifications may be required along with a background check and entrant, by participating, agrees to such check and agrees to provide full consent if required. Failure to comply may result in disqualification and, based on the criteria described above and time permitting, selection of another Runner-up to compete in the Interview Phase. In addition, at the discretion of the Sponsor, potential Runner-up Submissions may be disqualified for any of the following: if entrant is charged with or convicted of a felony or misdemeanor, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government ordered payment, such as but not limited to: child support, spousal support, alimony, tax payments, etc. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a potential Runner-up within a reasonable time period or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, an alternate Runner-up being chosen. Runner-up status is subject to verification of eligibility and compliance with these Official Rules.
Runner-up Video Submission:
Upon verification, each Runner-up will be required to submit a new video (no more than sixty (60) seconds in length) of his/her Eligible Child describing how they live the PLAY 60 Lifestyle (hereafter the “Runner-up Video”). The Runner-up Video must adhere to all Contest Submission Requirements as set forth in Section 4 of these Official Rules. Runner-up Videos must be submitted within two (2) days of the date of notification to be eligible to move onto Round 2 of Judging.
B. Round 2 of Judging: During Round 2 of judging, a separate panel of qualified judges, determined by Sponsor (in its sole discretion), will judge each of the thirty (30) Runner-up Videos based on the Judging Criteria specified above in Round 1. The eight (8) Runner-up Videos receiving the highest scores during Round 2 of the judging, as determined by the judges in their sole discretion, will be deemed Semi-Finalists, upon verification of eligibility and compliance with these Official Rules, and will receive a Semi-Finalist Prize. Sponsor and judges reserve the right to advance fewer than eight (8) Semi-Finalist Entries if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Videos. Upon verification of eligibility and compliance with these Official Rules, each Semi-Finalist will advance to the Interview Phase for the opportunity to advance to the Contest Voting Period.
In the event of a tie during Round 1 or Round 2 of judging, the tied Entries will be re-judged based on: Ability to Portray Passion: 0-100 points. By participating, entrants agree to abide by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters relating to this Contest.
Semi-Finalist Interview Phase
Upon receipt of the Semi-Finalist Video, the Sponsor will schedule a video and/or telephone interview with the entrant of each Semi-Finalist Submission and his/her Eligible Child depicted in the Semi-Finalist Submission (each, an “Eligible Subject”) and such Semi-Finalist entrant must be present at the time of the interview. The interviewer(s) (hereafter, “Interviewer(s)”) hosting the interview of the Semi-Finalist Eligible Subjects are determined by Sponsor in its sole discretion. The interview with each Semi-Finalist Eligible Subject will be approximately the same length of time, and the questions asked of each will be the same. All interviews will be recorded and must be completed by 11/10/17. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a Semi-Finalist within a reasonable time period and/or schedule and complete the interview, or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, a runner-up being chosen.
Upon completion of all interviews, a panel of judges determined by Sponsor in its sole discretion will judge each of the recorded interviews and Semi-Finalist Videos based on the Judging Criteria. The three (3) Semi-Finalists receiving the highest scores, as determined by the judges in their sole discretion, will be deemed potential Finalists, and will receive the Finalist Prize and advance to the Contest Voting Period outlined below. Sponsor and judges reserve the right to advance fewer than three (3) Finalists if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Semi-Finalists.
In the event of a tie, the tied interviews will be re-judged based on: Presentation: 0-100 points.
C. The Contest Voting Period:
A combination of the originally submitted Submission along with the Semi-Finalist Video (at Sponsors sole discretion) and recorded interview responses (hereafter, the “Finalist Submission”) will be combined by the Sponsor and posted during the Contest Voting Period at NFLRUSH.com/superkid for public voting. To vote for a Finalist Submission, legal residents of the fifty (50) United States and District of Columbia will be directed to visit NFLRUSH.com/superkid during the Contest Voting, and using a personal computer or mobile device, follow the prompts provided view each of the Finalist Entries and click on the applicable “Vote” button to cast their vote for the one (1) Finalist Submission in which they think would be the best ambassador for PLAY 60.
At the conclusion of the Contest Voting Period, the Finalist Entries will be ranked from one through three (with one being the highest ranked) based on the following: (i) on the number of eligible votes submitted by voters; (ii) Sponsor’s ranking of the Finalist Entries based on presentation (does the Eligible Child in the Submission deliver his/her message with compelling expression and appeal); and (iii) Interviewer(s) ranking of the videos based on presentation (does the Eligible Child in the Submission deliver his/her message with compelling expression and appeal). Each of the three (3) rankings will carry equal weight. The highest ranked Finalist Submission will be determined the Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie during the Contest Voting Period, such tied Finalist Entries will be re-judged (by a panel of judges determined by Sponsor in its sole discretion) based on Presentation: does the Eligible Child in the Submission deliver his/her message with compelling expression and appeal: 0-100 points.
All vote counting will be conducted at the direction, and in the sole discretion, of the Sponsor. The use of automated devices (or any other devices intended to automate or subvert any aspect of entry or voting or any other procedure that subverts the Submission process) to cast a vote is prohibited and any vote through such means will, at Sponsor’s sole discretion, be void. Sponsor reserves the right, in its sole discretion, to void any votes of entrants whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or is in violation of these Official Rules. Eligible Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Neither Sponsor, nor anyone acting on its behalf, will enter into communications with any entrant regarding the Contest other than to notify the potential Semi-Finalists, Finalists and Grand Prize winner.
Eight (8) Semi-Finalist Prizes: Each Semi-Finalist will receive a PLAY 60 prize pack consisting of PLAY 60 items to be determined by Sponsor in its sole discretion. Exact items, colors and sizes are at Sponsor’s sole discretion. Approximate Retail Value (“ARV”) of each Semi-Finalist prize pack = $125.
Three (3) Finalist Prizes: Each Finalist will receive: (i) two (2) tickets to a 2018 NFL regular season home game taking place near winners’ residences, and (ii) a one (1) year supply of select Dannon® Danimals® products. ARV of each Finalist prize package = $585. Year supply of Dannon® Danimals® products is valued at approximately $335 and consists of twelve (12) total shipments of select product(s). Exact product type, flavor, amount of product, and shipment dates as determined in Dannon’s sole discretion and based upon product availability. Entrant of winning Finalist Submission must attend 2018 regular season game with the entries’ Eligible Subject. In the event an NFL team is not within one hundred fifty (150) miles, as determined by Sponsor, from winner’s residence, ticket portion of the prize may be awarded (at Sponsor’s sole discretion) in the form of a $250 NFLShop.com Gift Card. Terms and conditions on NFLShop.com Gift Card may apply. Travel to/from game is not included as part of the prize. Exact 2018 NFL regular season game tickets at Sponsor’s discretion. In the event tickets to a 2018 NFL regular season game are not available or selected game is postponed and not rescheduled or otherwise cancelled, or in the event Dannon® Danimals® products are not available for shipment or products are no longer produced or otherwise not available, no compensation or substitution for such portion of the prize will be provided; however, the remainder of prize package will be awarded and Sponsor will have no further obligation to winner.
One (1) Grand Prize: A seven (7) day/six (6) night trip for four (4) (winning entrant, his/her Eligible Child and up to two (2) additional Guests) to attend Super Bowl LII scheduled to take place on 2/4/18 in Minneapolis, MN. Trip consists of a) round trip coach class air transportation for four (4) from a major U.S. gateway airport nearest winner’s residence to destination city; b) standard hotel accommodations (one (1) room, quadruple occupancy) for six (6) nights; c) $750 in the form of a check to be used for ground transportation in Minneapolis; d) attendance for four (4) at NFL Kids’ Day at Super Bowl LII with credential access; e) attendance for four (4) at Super Bowl LII Game Day Fan Plaza; f) four (4) NFL Experience tickets; g) four (4) tickets to Super Bowl LII; g) NFL car service to and from the game; and h) a total of $1,000 spending money awarded (to winning entrant only) in the form of a check. Additionally, the Eligible Subject will have the special experience to be on the field for the Super Bowl pre-game and will hand the official game ball to a member of the officiating staff prior the start of Super Bowl LII. ARV of Grand Prize package = $23,990. Actual prize value may vary based upon location of winner’s residence. Any difference between stated value and actual value will not be awarded. If winner resides within a one hundred fifty (150) mile radius of a destination city, ground transportation may be provided in lieu of air transportation at Sponsor’s sole discretion, and no compensation or substitution will be provided for difference in prize value. Trip must be taken on dates designated by Sponsor or prize will be forfeited in its entirety and, at Sponsor's discretion, awarded to a runner-up. Travel and accommodation restrictions and other restrictions may apply. Winner and his/her guest(s) must travel together on same itinerary for both trips and are responsible for obtaining all required travel documents. All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Released Parties are not responsible for travel delays or cancellations. In the event Super Bowl LII is postponed and rescheduled, the trip will be rescheduled. In the event any related event is postponed and not rescheduled, no compensation or substitution for such portion of the prize will be provided; however, the remainder of prize package will be awarded and Sponsor will have no further obligation to winner.
For Finalist and Grand Prizes: Seat locations and other details will be determined by the Sponsor in its sole discretion. Winner and guest(s) must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Released Parties reserve the right to remove or to deny attendance to any winner and/or guest(s) who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at a game or any event. The tickets are subject to the terms and conditions specified thereon. If unused, tickets cannot be returned, refunded or exchanged for cash value or substitute tickets.
For all Prizes: All prize details will be determined by Sponsor and Dannon (as it relates only to the Finalist Prize) in its discretion. All prizes are awarded “as is” without any warranty or guarantee, either expressed or implied, by Sponsor. Costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, (and as applicable, food, beverages, luggage fees, souvenirs, gratuities and miscellaneous travel expenses) are winners' sole responsibility. A 1099 tax form will be issued in the amount of the Prize to the winning entrant. Total ARV of all prizes = $25,740.
License/ Use of Contest Submissions: By posting a Submission, and to the extent allowed by law, you agree to grant Sponsor and its designees with a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, adapt, modify, publish, exploit and use the Submission in any way and in any and all media now known or hereinafter discovered or devised, world-wide for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to entrants or any third parties.
Entrants further agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding. Entrant's posting of a Submission constitutes his/her representation of eligibility, consent to participate in Contest and consent for Sponsor to obtain, use, and transfer his/her name, address and other information for the purpose of Contest administration. Released Parties are not responsible for lost, incomplete, invalid, unintelligible, inaccurate, undeliverable, garbled, late, stolen, damaged or misdirected Entries or votes, all of which will be disqualified; failures or malfunctions of phones, phone lines or telephone systems or other communications or malfunctions; interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrants’ or any other person’s computer or mobile device related to or resulting from participation in the Contest; theft, destruction or unauthorized access to, or alteration of, Entries or votes; or human-processing error; printing, typographical or other errors or omissions in these Official Rules or in any Contest-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, network, electronic; or errors which may occur in connection with the administration of the Contest, the incorrect uploading of Entries, the processing or judging of Entries, the tabulation of votes, the awarding or announcement of the winners, Semi-Finalists or Finalists or in any other Contest-related materials. Sponsor reserves the right to void and remove any and all Entries of an entrant or votes of a voter who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Contest and such entrant/voter will be disqualified and all associated Entries and/or votes will be void. All Entries become property of Sponsor and will not be returned. Sponsor reserves the right, in its sole discretion, to post all approved Entries on NFLRUSH.com/superkid for public viewing. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON(S) FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Except where prohibited by law, as a condition of participating in this Contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.
9) Choice of Law:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
